HoneyGuide Private Limited (henceforth: HoneyGuide) offers a variety of bookable tours, experiences, flight tickets, hotel/lodge booking, guide booking, information, and similar products (henceforth referred to as ‘Products’) through the website www.honeyguideapps.com and its mobile apps (Henceforth referred to as the Booking Platform, Website, or Site). Suppliers of these Products offer such Products on their own behalf and under their own responsibility.

Acceptance of Terms and Conditions

Your use of this Website is subject to your irrevocable acceptance without modification of these Terms of Use, the Business Terms of Use, and our Security and Privacy Policy. You agree to use this Website in accordance with all of the aforementioned terms and subject to all of the aforementioned terms.

HoneyGuide reserves the right to change the content, structure, functionalities of the Booking Platform at any point in time, including suspending in full or partially the Website, or blocking access to visitors of the Website in partial or in full, without any reason, at any point in time, and with immediate effect. HoneyGuide is the owner and proprietor of all information published on its Booking Platform, including customer reviews, product, and supplier information. All such information may not be used or distributed by any parties before such parties have received HoneyGuide's written consent.

Whenever you visit the Booking Platform you are always legally bound by the Terms of Use.

General Terms of Business of HoneyGuide and Suppliers of Products

For booking services via the Website, the Business Terms of Use and the Terms of Business of Suppliers of Tours and Bookers as well as the additional conditions of suppliers shall apply.

You should note that HoneyGuide does not warrant that the information published on this Website will be error free and in using this Website you acknowledge that the Product details and all other information, including but not limited to supplier information, customer information, and other information published on the Website etc may include errors, inaccuracies, mistranslations, or typographical errors.

All information published on Website including but not limited to customer reviews, company reviews, supplier information, product information, blog articles and other types of information published on the Website, is the sole ownership and propriety of HoneyGuide. All such information may not be used or distributed by any other parties in whole or in part, before such parties have received HoneyGuide's prior written consent.

All bookings are made with the supplier offering the Product in question, not with HoneyGuide. HoneyGuide only facilitates the making of the reservations with the suppliers of Products and sometimes the payment as well. HoneyGuide is not a party to the contract between you as a customer and the supplier of the Product and therefore has no responsibility or liability to you in respect of the terms of that contract whether directly or indirectly.

As a condition to the use of this Booking Platform you hereby confirm and undertake to HoneyGuide that:

You are not a national of Cuba (a “Restricted National”) and acknowledge that use of this Website by or on behalf of a Restricted National is prohibited; and

You hereby confirm and undertake to HoneyGuide that if you are a national of Iran, Syria, Sudan, Myanmar (Burma), or North Korea (“Other Restricted Territory”) that your credit card is not issued through an “Other Restricted Territory” nor is your booking made while you are present in an “Other Restricted Territory”; and

You confirm and undertake to HoneyGuide that you will not use this Website for any purpose that is unlawful or prohibited by these Terms of Use.

You confirm and undertake that you are of sufficient legal age to use this Website and to create binding legal obligations for any liability you may incur as a result of the use of this Website. You furthermore understand that you are financially responsible for all uses of this Website by you and those using your log-in information.

Payments

Upon requesting to make a booking of a Product with a supplier your credit card will be charged. However, if the supplier does not accept the booking within 48 hours the charged amount will be credited back to your account.

When making a booking, HoneyGuide charges the full payment upfront for some Products and for other Products HoneyGuide merely charges a deposit after which the remaining payment is required to be made to the supplier directly upon arrival, or to HoneyGuide before the Products start date. For any payments made on Website, all such payments are made to HoneyGuide.

If you did not pay for the booked Product or if your credit card is revoked, your claim to receive the Product is cancelled. Such instance shall be regarded as a cancellation and the cancellation policy policy stated in point 6 below shall apply.

After payment, the booker is responsible for showing up at the specified start date and time. In case the booker does not show up, this shall be regarded as a no-show, and full payment shall still be made to the supplier. Cancellation is not possible.

This Website may contain hyperlinks to websites operated by parties other than HoneyGuide. Such hyperlinks are provided for your reference only. HoneyGuide does not control such websites and is not responsible for their contents. The inclusion of hyperlinks on this Website to such other websites does not imply any endorsement of the material on such websites or any association with their operators.

Links to this Website

You are granted a limited, nonexclusive right to create a "hypertext" link to the home page of this Website provided that such link does not portray HoneyGuide or any of its other products or services in a false, misleading, derogatory, or otherwise defamatory manner. This limited right may be revoked at any time for any reason whatsoever. You may not use, frame, or utilize framing techniques to enclose any HoneyGuide trademark, logo or trade name or other proprietary information including the images found at the Website, the content of any text or the layout/design of any page or any form contained on a page without the express written consent of HoneyGuide.

Data Collection and Usage

When visiting the Website, HoneyGuide collects certain data (e.g. IP address, browser type) for statistical purposes. Such data including data that you transfer to use e.g. when making booking queries or communicating with suppliers or other data transfers to us, may be used for the purpose of improving this Website, for contract settlement, presentations, design, analysis, marketing and consulting purposes.

If you have accepted to receive our newsletter, or other updates by HoneyGuide we reserve the right to send you regular updates about Products, offers, news and other pieces of information.

When booking a Product at the Booking Platform you give us permission to send you relevant messages and documents online, including giving the supplier of such Product permissions to send you messages and documents. For more details please see the Business Terms of Use.

All information published on HoneyGuide, irrespective of whether such information has been received by customers or suppliers of HoneyGuide, including but not limited to customer reviews, company reviews, supplier information, product information, blog articles and other types of information published on HoneyGuide, is the sole ownership and propriety of HoneyGuide. All such information may not be used or distributed by any other parties, before such parties have received HoneyGuide's prior written consent. Failure to adhere to this requirement is a criminal offence, punishable by law.

Registration and cookies

When you register an account all information submitted through such account including but not limited to full name, profile picture, date of birth, credit card data etc will be stored at our side. Please note, however, that should you apply your credit card information such data will not be stored by our side but at the credit payment gateway provider which HoneyGuide has chosen to process secure payments of Products and other services. HoneyGuide explicitly excludes any liability caused by such chosen payment gateway provider in storing your credit card information.

When creating an account you are giving HoneyGuide permission for online communication including allowing us to send our email newsletter or other electronic newsletters. You can at any time unsubscribe from such newsletters.

HoneyGuide may use cookies on our Website. Cookies are a feature within your internet browsing software and store data about the use of Websites on your computer. If HoneyGuide sees fit we may make use of such information.

Sharing information with third parties

When you conclude a purchase of a Product or other service offered on the Booking Platform, some or all of the data you have provided to HoneyGuide will be transmitted to the owner of such Product allowing such owner to ensure a proper execution of the booked Product.

Whenever required by authorities or legal bodies HoneyGuide will also pass on requested information by such legal authorities.

HoneyGuide hereby reserves the right to transmit such data to third parties, authorities etc.

Liability

While HoneyGuide makes all reasonable efforts to ensure that the Products listed are of reasonable standard the listing of any supplier and Products on the Website is not and should not be taken as a recommendation from HoneyGuide or a representation that the Product or supplier of such Product will be suitable for the user’s purpose. HoneyGuide shall in no way be liable to you in the event that a supplier or Product is not suitable for your purpose.

While HoneyGuide’s terms requires that each and every supplier and their respective Products display prices at the Booking Platform which are inclusive of all value added tax, other taxes, or other expenses, it is ultimately the responsibility of the supplier and not HoneyGuide. By using this Website you therefore acknowledges that HoneyGuide shall have no liability to you in respect of any attempt by a supplier to levy additional value added taxes or other taxes, or expenses in addition to the already paid amount at HoneyGuide. The sole recourse in such regard shall thus be against the supplier and not HoneyGuide.

BUSINESS TERMS OF USE

HoneyGuide Private Limited (henceforth: HoneyGuide) offers a variety of bookable tours, experiences, flight tickets, hotel/lodge booking, guide booking, information, and similar products (henceforth referred to as ‘Products’) through the website www.honeyguideapps.com and its mobile apps (Henceforth referred to as the Booking Platform, Website, or Site).

We recommend that you read these Business Terms of Use, and also the Terms of Use and the Security and Privacy Policy because they do contain legal obligations.

Unless otherwise stated, HoneyGuide and any affiliated websites are subject to these Business Terms of Use, the Terms of Use and our Security and Privacy Policy.

These Business Terms of Use govern the usage of this website when you signup (i.e. register an account), book a Product, or post information on this website. If booking a product, please also refer to our Terms of Business of Suppliers of Tours and Bookers.

Upon registering an account, you agree to these Business Terms of Use, the Terms of Use and the Privacy Policy of HoneyGuide.

1. Registration of accounts / User accounts / Others

1.1. Opening and closing of a user account

You can register at this website and open a user account. When you register you are required to register with your official name, provide accurate information, and keep it updated at all times. You are responsible for all activities that occur in connection with your account.

Prior to booking a Product on www.honeyguideapps.com sometimes also referred to as the HoneyGuide Booking Platform, or the Booking Platform, you need to open a user account and register. Should you at the time of booking not have created an account we will automatically create an account for you when having confirmed payment and the booking.

After getting a user account you update your profile. For all information entered into the Booking Platform you are required to always provide truthful information, and keep it up-to-date at all times. HoneyGuide will not be liable if a booking of a Product for some reason cannot be carried out caused by inaccurate information, or other information provided by you.

One legal person and company cannot register more than one user account. When registering you always need to register with your official name.

We reserve the right to close your account at any time for any or no reason.

1.2 Eligibility to register a user account

Registration is restricted to actionable persons. In the case of registration of a supplier or a legal body, the person conducting the registration must be authorized to act in the name of the supplier or legal entity.

There is no entitlement to registration or use of the HoneyGuide Booking Platform.

HoneyGuide reserves the right to reject, exempt or delete any user that either applies or has already become a member of HoneyGuide.

1.3. Unbinding Offers

All Products and other services available at HoneyGuide are non-binding offers.

1.4 Booking request / Obligations / Acceptance of Supplier

If you decide to book a Product, you need to make the booking through the relevant booking interphase on the Booking platform and enter accurate information. The request to book is final once you confirm payment at the website. The charges for the booked service will be deducted from your applied credit card or paypal account.

After the final request to book, some Products are confirmed instantly. Other Products will only be answered to within 2 working days. If the supplier accepts the booking request, the contract between you as a customer and the supplier becomes effective. If the supplier does not accept the booking request, the contract does not become effective. In case a supplier does not accept the booking request you will be notified via email.

The supplier provides the agreed Product under his own account. It is therefore solely the responsibility of the supplier to deliver the agreed product to you, and when booking a Product you as a customer and the supplier are the contracting parties.

1.4.a. Eligibility Requirements

The supplier may set eligibility requirements for his Product which will be displayed at the Product booking page, before proceeding to checkout at the website. It is your own responsibility to make sure that you can comply with these requirements. The supplier is allowed to exclude you from participation of the booked Product in case you do not comply with the eligibility requirements set. In such case, no refund of the booked Product will be made.

1.5. Communication of cancellation or amendment

If you successfully make a booking of a Product at www.honeyguideapps.com, cancellation or amendment of such confirmed Product needs to be performed in writing via the specific forms provided on our website. In case you do not apply the forms we have advised on the website, it may not be possible for us to complete the termination or amendment of the booking, in which case we should not be liable.

1.6. Communication between you and the suppliers

After having registered an account it will be possible for you to communicate with different suppliers on the website. HoneyGuide is not responsible or liable for what neither you nor the supplier communicates to each other.

Should the supplier communicate with you at our website and offer you to book his Product under certain terms and conditions such terms and conditions will take effect after making a booking through the website. However, such booking terms and conditions cannot relieve you and the Supplier of the obligations contained within these Business Terms of Use. Should such agreed upon terms and conditions, inclusions or exclusions, or other information differ from the Supplier’s publicly available information, the information communicated in the message from the supplier to you as a customer, or vice versa, the message in the correspondence will prevail, provided that it does not levy any commitment or further liability on HoneyGuide.

2. Content

You can contribute to the site in a number of different ways including but not limited to writing reviews, asking or/and answering questions in our forums, filling out your public profile, uploading a profile image etc (henceforth referred to ‘Your Content’).

You alone are responsible for Your Content. You resume all liability and all risks associated with Your Content including anyone’s reliance on it. You represent that you own, or have the necessary permissions to use, and authorize the use of Your Content, as defined herein.

You may expose yourself to liability if your Content:

Violates any law or regulation including but not limited to any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right

Contains material that is false, intentionally misleading, or defamatory

Contains material that is unlawful, including illegal hate speech or pornography; exploits or otherwise harms minors; or violates or advocates the violation of any law or regulation.

You give HoneyGuide an irrevocable, non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any of Your Content in a number of different ways, including displaying it on the site, reformatting it, editing it, promoting it, distributing it, deleting it in part or in full, and allowing HoneyGuide to grant such rights to use Your Content to third parties. As such you irrevocably grant HoneyGuide permission to use Your Content for any purpose. You irrevocably waive any claims and assertions of intellectual and moral rights or attribution with respect to Your content.

We may delete or reinstate some or all of Your Content from time to time at our sole discretion. We have no obligation to retain or provide you with copies of Your Content, nor do we guarantee any confidentiality with respect to Your Content.

HoneyGuide and any of its affiliates may display advertisements and other information including Your Content on their websites or other medias. You are not entitled to any compensation for such advertisements or any other ways in which Your Content is used.

3. Legal relationship and liabilities

3.1. Legal relationship with HoneyGuide

HoneyGuide only facilitates the making of reservations by visitors of www.honeyguideapps.com with the Suppliers of Products except for some content it provides. HoneyGuide is thus not a party to the contract between you as a customer and the supplier of the Product and therefore has no responsibility or liability to you in respect of the terms of that contract, whether directly or indirectly.

3.2 Liability of HoneyGuide

HoneyGuide is only liable to you in the case of Willful Misconduct or Gross Misconduct (including Gross Negligence). Any such liability is limited to the direct damages caused excluding indirect damages, consequential loss, loss of profit etc. The liability for punitive damages is also excluded.

HoneyGuide also excludes any liability for computer viruses, spyware programs or similar.

3.3 Your Liability

If you cause any damages to HoneyGuide or the HoneyGuide Booking Platform you will be held responsible for it.

4.0 Changes of these Business Terms of Use

These Business Terms of Use may be changed by HoneyGuide at any time and with immediate effect, without any prior notice. For each booking of a Product the prevailing Business Terms of Use at the time of such booking shall take effect.

 

TERMS OF BUSINESS OF SUPPLIERS OF TOURS AND BOOKERS

1. Introduction

These Terms of Business of Suppliers of Tours and Bookers (henceforth: Terms) shall be applicable to the contract entered into between a user of the HoneyGuide Booking Platform available at www.honeyguideapps.com and the supplier, when such user makes a booking of a tour, experience, ticket, adventure, or related product (henceforth: ‘Products’) offered and owned by such supplier, having made his Products available at www.honeyguideapps.com . Such user (henceforth also called a ‘booker’) and such supplier will in these Terms also be referred to as the contracting parties.

2. Acceptance of bookings

Only people who are authorized and can act in the name of the supplier can accept bookings by a booker on www.honeyguideapps.com

If a supplier accepts a booking of a Product but subsequently finds out that the information provided by such booker when making a booking was intentionally not truthful, the supplier shall have the right to cancel the booking. For such cases the price already paid by the booker cannot be refunded.

3. Booker responsibilities

You are responsible for timely arrival at the Product meeting and starting point. Should you for some reason be delayed and provided that such delay significantly impedes the execution of the Product, the supplier is allowed to cancel the booking. In case of such cancellation, no money paid will be refunded to the booker. However, exceptions will be made to the previous if a prior arrangement has been made, communicated and agreed upon by the relevant parties.

As a booker you are responsible for full compliance of the conditions of participation of the Product. At the sole discretion of the supplier s/he can exclude you from participation of a booked Product provided that you are not in full compliance of the conditions of participation. For such cases, no refund can be made to participants who are not in compliance, provided that the supplier listed all such requirements of participation in the Product, at the time of booking.

Immediately after making payment, the contract between you as a booker and the supplier of such Product will be concluded, provided that the supplier either immediately or within 48 hours accepts such booking. In making payment you are thus making a binding offer which will be valid for at least 48 hours after payment. In case the supplier does not accept your binding offer within 48 hours, you will be notified via e-mail. After accepting a booking the supplier will provide the agreed services under his own behalf and at his own responsibility.

4. Contracting Parties

All bookings are made with the supplier offering the Product in question, not with HoneyGuide. HoneyGuide only facilitates the making of the reservations with the suppliers of Products. HoneyGuide is not a party to the contract between you as a customer and the supplier of the Product and therefore has no responsibility or liability to you in respect of the terms of that contract whether directly or indirectly.

5. Payment

Upon requesting to make a booking of a Product with a supplier your credit card will be charged. However, if the supplier does not accept the booking within 48 hours the charged amount will be credited back to your account.

When making a booking, HoneyGuide charges the full payment for some Products and for other Products HoneyGuide merely charges a deposit after which the remaining payment is required to be made to the supplier/HoneyGuide at a later point in time. For any payment made on HoneyGuide’s Booking Platform, all such payments are made to HoneyGuide.

If you did not pay for the booked Product or if your credit card is revoked, your claim to receive the Product is cancelled. Such instance shall be regarded as a cancellation and the cancellation policy policy stated in point 6. below shall apply.

After payment, the booker is responsible for showing up at the specified start date and time. In case the booker does not show up, this shall be regarded as a no-show, and full payment shall still be made to the supplier. Cancellation is not possible.

6. Disclaimer on the right to cancel

After requesting to book a Product should the applicable law between the contracting parties grant you as a booker a right of cancellation in your favour, you waive such right, to the extent permitted by law.

7. Cancellation policy

7.1 Cancellation by the booker

If you cancel the Product, the cancellation policy stated in the booking confirmation received is authoritative. Please therefore always read the booking confirmation carefully.

In case the supplier has not specified any cancellation policy in the booking confirmation received the following cancellation policy shall apply:

Content: Full refund within 7 days of purchase or in case of technical difficulty upto 1 month.

Flights: 10 percent deductions will apply for cancellations made 48 hours before the flight. 35 percent will be deducted for cancellations made between 48-6 hours. No refund will be given for cancellations made within 6 hours of the flight time.

Lodges: The following framework will apply for cancellation of lodge bookings: Before 30 days of the stay date, full refund will be made. Within 30 days of the stay date, 15% of the trip cost will be deducted. However please note that showing up +/-2 days around the actual date will not result in denial of service and no additional charges will apply.

Third Party Packages: For third party packages of less than 1 day duration: For cancellations done before 7 days, full refund will be provided. For cancellations within 7 days of the start of the trip date, the deposit of 10% will be deducted. For third party packages lasting 1 or more days: For cancellation before 30 days of the trip start date, the 15% of the cost will be deducted. Between 30 and 15 days of the trip start date, 30% of the cost will be deducted. For cancellation within 15 days of the trip start date, 50% of the cost will be deducted.

For communication of a cancellation notice, please inform HoneyGuide in writing via info@honeyguideapps.com . Only notices communicated in the manner advised shall be valid, unless HoneyGuide accepts another form of notice.

Any refund required to be made to the booker will be made within 22 working days to the credit card used, when initially making a booking.

If a payment was not made for the booked Product or if the credit card was revoked, this shall be regarded as a booking cancellation. In such case HoneyGuide reserves a claim for further damages.

7.2 Cancellation by the supplier

Should circumstances beyond the control of the supplier hinder him in carrying out the booked Product in safe manners, he shall have the right to cancel the Product. In such case a full refund shall be made to the booker and the supplier shall not be compensated for any damages incurred.

Should a supplier already have started to execute a Product but be forced to stop the execution of the Product before its end due to circumstances beyond the control of the supplier hindering him in carrying out the Product in full, the supplier shall be entitled to cancel the Product and also be entitled to compensation on a pro-rata basis basis the time he has already spent carrying out the Product with the customer divided by the total duration of the Product.

The supplier shall also have a right to exclude you as a booker from participating in the booked Product if you do not meet the participation requirements stated at the Product page booking the product or if you otherwise compromise the safety of yourself or others, or otherwise interferes with the proper conduct of the Product. For such cases you will not receive any refund of the booked Product.

For communication of a cancellation notice, please always use the method specified in either the booking confirmation or on www.honeyguideapps.com. Only notices communicated in the manner advised shall be valid.

8.0 Product changes

The supplier is allowed to make minor changes to the content of the Product if necessitated by unforeseeable or unpreventable circumstances.

9.0 Insurance for the booked Products

Unless otherwise stated insurance is not included in the booked Products. It is your own responsibility as a booker to take out the necessary insurance to carry out the Product in safe manners.

10. Other conditions

Other conditions for the Product can be found on the Product page. Product conditions specified herein shall be applicable from the time of booking.

11. Time calculation and time zone

For time and date calculations the timezone of the supplier shall apply.

12. Liability of the supplier

The supplier shall be liable according to the applicable law.

13. Changes of this Agreement

These Terms can be changed by HoneyGuide at any given point and time with immediate effect. The Terms governing a booking shall be the applicable Terms at the time of booking.

14. Legal relationship between the contracting parties

The legal relationship governing the contracting parties shall be governed in all cases according to the applicable law.
